How to Authenticate Text Messages in Court

Authenticating text messages in court is crucial for using them as evidence in legal cases. To ensure text messages are admissible, they must be properly authenticated to prove they are genuine and not tampered with.


Here’s a quick guide to the process:


First, you need to identify the sender and recipient of the messages. This can be done by showing that the phone number belongs to the person in question, usually by cross-referencing phone records or testimony from a witness who regularly communicates with them. Additionally, contextual evidence, such as content that only the person involved would know, can help verify authenticity.


Next, preserve the messages in their original form. Screenshots may be useful, but obtaining a forensic copy is the most reliable way to show the messages haven’t been altered. Using third-party software to extract and preserve the entire conversation is ideal.


Finally, make sure to submit metadata, which can include information like timestamps and message routing. This helps further establish authenticity.
