Can You Expunge Multiple Convictions at Different Times in Indiana?

Indiana’s expungement law is full of opportunities, but also strict rules. One of the most confusing is the “one-time petition rule.” To illustrate how this works, let’s look at a hypothetical situation many people find themselves in.

The Hypothetical

  • In 2015, Jordan was convicted of a misdemeanor for a minor offense. By 2020, Jordan had completed all requirements and was eligible to seek expungement.

  • But Jordan didn’t file. Life was busy, and the record didn’t seem like a big deal at the time.

  • In 2018, Jordan picked up a Level 6 felony conviction. By 2026, this felony would also be eligible for expungement, provided all waiting periods and requirements were met.

Now Jordan wants to know: Can I file to expunge my 2015 misdemeanor now, and then come back later in 2026 to expunge the 2018 felony?

The Answer

The short answer: No.

Here’s why:

  1. The One-Time Petition Rule (IC 35-38-9-9).

    Indiana law generally allows you to file for expungement only once in your lifetime. That means all eligible convictions must be included in a single petition, filed at the same time.

  2. Filing Twice Is Not Allowed.

    If Jordan expunged the 2015 misdemeanor now, the 2018 felony would not be eligible later. Filing early could permanently block the chance to clear the more serious record.

  3. Strategy Is Key.

    Because of this rule, timing becomes critical. Many people wait until all their convictions are eligible so they can file one comprehensive petition. This prevents losing the chance to clear later convictions.
