Getting charged with a crime is overwhelming. Being convicted can feel final like the story is written and there’s nothing you can do. But for many people in Indiana, that’s not the end of the story. Expungement laws can offer a path from a past conviction to a cleaner future.
Here’s a big-picture look at how that journey typically works.
Step 1: The Criminal Case and Sentence
The process starts with the original criminal case: the arrest, charges, and ultimately a conviction through a plea or trial. The court then imposes a sentence, which might include:
Jail or prison time
Probation
Fines and court costs
Community service
Classes or treatment programs
To eventually qualify for expungement, you generally must complete all sentencing requirements.
Step 2: Time Passes and Your Life Moves Forward
Expungement usually isn’t available immediately after a case ends. Indiana law requires waiting periods that vary depending on the type of offense and your record.
