What Crimes Are Not Eligible for Expungement in Indiana?

Here’s what you need to know about which crimes are not eligible for expungement in Indiana.


Crimes That Cannot Be Expunged 


1. Sex Offenses Involving Minors

Crimes that require you to register as a sex or violent offender, especially those involving minors, are not eligible for expungement.


2. Official Misconduct

If you were convicted of a crime involving official misconduct, such as misuse of public office or corruption, these convictions cannot be erased.


3. Homicide Offenses

Convictions for murder or voluntary manslaughter cannot be expunged. Indiana law makes these exceptions due to the seriousness of the offense.


4. Human and Sexual Trafficking

Convictions related to human trafficking or certain forms of sexual trafficking are ineligible for expungement.


5. Violent Crimes Resulting in Serious Bodily Injury

If you were convicted of a violent crime that resulted in serious bodily injury to another person, these cases generally cannot be expunged.


Why Are Some Crimes Ineligible? 

Indiana lawmakers set these limits to protect public safety and acknowledge the severity of certain crimes. While many misdemeanors and non-violent felonies may be cleared, these exceptions are designed to keep records of the most serious offenses intact.
